Terms of service

These terms govern your use of atziproducts.com (the "Site") and your purchases from it. The Site is operated by Salvador Gutierrez dba Atzi Products ("Atzi Products," "Atzi," "we," "us"), a sole proprietorship in Glendora, California. By using the Site or placing an order, you agree to these terms, our Shipping and Returns and Refunds policies and our Privacy Policy. If you do not agree, please do not use the Site.

Use of the Site

You may use the Site to learn about and buy our products and to contact us. You agree not to:

• use the Site for any unlawful purpose;
• try to get into systems you are not authorized to use, or test, scan or interfere with the Site's security;
• send false information, spam or harmful code through our forms or checkout;
• copy, scrape or republish product images or other content, except as these terms allow;
• use the Site in a way that harms Atzi, our customers or other users.

Terms of sale

These terms apply to retail orders placed on the Site.

Who can buy. You must be at least 18 years old to place an order. We ship to addresses in the United States only.

Our products. Our products are for spiritual use and sold as a curio and novelty only. No specific result is claimed or guaranteed. They are not food and are not for ingestion. Keep them out of reach of children and away from open flame. They are not intended to diagnose, treat, cure or prevent any disease, and are not a substitute for professional medical, legal, financial or other advice. Descriptions of traditional uses reflect custom and tradition, not promises of any outcome.

Prices and errors. Prices are in U.S. dollars and are shown on each product page and at checkout. We work to keep prices and product information accurate, but errors can happen. If an item is listed at an incorrect price or with incorrect information, we may cancel the order before it ships, tell you, and refund any amount charged. We may change prices at any time; a change does not affect orders we have already accepted.

Order acceptance. Placing an order is an offer to buy. The confirmation email you receive after checkout means we received your order; it is not yet our acceptance. We accept your order when we ship it. We may decline or cancel an order, or limit quantities, for example when an item is out of stock, an address cannot be served, or an order appears to be fraudulent or for resale. If we cancel an order after you have paid, we refund you in full.

Payment. Checkout and payment are run by Shopify, and card payments are processed by Shopify Payments. We do not see or store your full card number. Your payment is charged when you place your order.

Sales tax. We collect California sales tax, and sales tax for other states where we are required to, at checkout.

Shipping. Shipping rates, times and our policy for late shipments are described on our Shipping page.

Title and risk of loss. Ownership of the products and the risk of loss pass to you when the products are delivered to your shipping address. If a package is lost or damaged before it is delivered, we will replace or refund it as described in our Shipping and Returns policies.

Returns. Unopened items may be returned within 30 days of delivery, and broken, leaking or wrong items are replaced or refunded, as described in our Returns and Refunds policy.

Wholesale purchases

Businesses that buy our products for resale, such as botanicas and retail stores, can ask about wholesale pricing through the form on our Wholesale page or at wholesale@atziproducts.com.

• Wholesale pricing, minimums, payment and shipping are set in the written terms we provide with each wholesale order. Those terms govern that order and take priority over the Terms of Sale above.
• To buy without sales tax, a business must give us a valid resale certificate. The information you give us about your business must be true and complete.
• We may accept or decline any wholesale inquiry or order at our discretion.
• If you resell our products, you agree not to make medical claims or promise results about them, and to keep our labels and disclaimers as supplied.

Product information

We try to describe our products accurately. Product photos and label images are representations. Actual color, fill level, label and packaging may vary slightly from what is shown, and we may update formulas, labels or packaging from time to time.

Intellectual property

The Atzi Products name and logo, our product names, labels, artwork, photos, text and the design of the Site belong to Atzi Products or its licensors and are protected by law. Wholesale customers may use our product photos and descriptions only to sell genuine Atzi products, and must not alter them or suggest a partnership that does not exist. Any other use needs our written permission.

Feedback

If you send us ideas or suggestions, we may use them without any obligation to you.

Links to other sites

If the Site links to other websites, we are not responsible for their content or practices. Checkout pages are run by Shopify under its own terms and privacy policy.

Disclaimer of warranties

The Site and its content are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties about the Site, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will always be available or free of errors. Our commitments for products you buy are the ones in these terms and in our Shipping and Returns policies. Nothing in these terms limits any rights you have under law that cannot be waived.

Limitation of liability

To the fullest extent allowed by law, Atzi will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising from your use of the Site or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order, and for any other claim relating to the Site, to one hundred U.S. dollars (US$100). Some laws do not allow these limits, so they may not all apply to you.

Indemnity

If your misuse of the Site or breach of these terms leads to a claim against Atzi, you agree to cover the reasonable costs of that claim, including reasonable attorney's fees.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute relating to the Site, an order or these terms will be brought only in the state or federal courts located in Los Angeles County, California, and you and Atzi agree to the jurisdiction of those courts.

General

If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a term right away, we have not waived it. These terms, the policies they link to and our Privacy Policy are the entire agreement about use of the Site and retail orders. Written terms we provide for wholesale orders govern those orders.

Changes to these terms

We may update these terms from time to time. We will post the new version on this page and change the effective date above. The terms in effect when you place an order apply to that order. Using the Site after a change means you accept the updated terms.
